1. Introduction
FarmOps360 ("Company," "we," "us," or "our") operates the FarmOps360 platform and associated websites (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information, including information collected in connection with SMS/text message communications. It applies to all users of our Service, including residents of California and other states with applicable privacy laws.
By using the Service or providing your phone number to us, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our Service.
2. Information We Collect
We may collect the following categories of personal information:
- Identifiers: Name, email address, phone number, mailing address, IP address, account username.
- Commercial Information: Subscription plan details, transaction records, and purchasing history.
- Agricultural / Operational Data: Field records, equipment data, crop information, financial records, and other farm management data you enter into the platform.
- Usage Data: Pages visited, features accessed, browser type, device identifiers, and log data.
- Communications Data: Records of SMS opt-in consent, opt-out requests, and message history.
3. SMS / Text Message Communications
3.1 Program Description
FarmOps360 may send you text messages (SMS/MMS) for the following purposes:
- Transactional Messages: Account alerts, password resets, platform notifications, billing confirmations, and messages related to your active use of FarmOps360.
- Informational Messages: Platform updates, feature announcements, service status alerts, and onboarding guidance.
- Marketing Messages: Promotions, early access offers, product news, and agricultural market updates (only with your express prior written consent).
3.2 How to Opt In
You may opt in to receive SMS messages from FarmOps360 by one of the following methods:
- Checking the SMS consent checkbox during account registration or profile setup;
- Submitting your phone number through our Early Access or Contact forms with the SMS consent option selected; or
- Texting a designated keyword to our short code or long code number as specified at the point of sign-up.
By opting in, you expressly consent to receive recurring automated text messages from FarmOps360 at the phone number provided. Consent is not a condition of purchasing any goods or services. Message frequency will vary based on your account activity and the message type. You represent that you are the authorized user of the mobile number provided.
3.3 How to Opt Out (STOP)
You may opt out of receiving SMS messages from FarmOps360 at any time by any of the following methods:
- Reply STOP to any text message you receive from us;
- Reply STOP ALL to unsubscribe from all FarmOps360 SMS programs at once;
- Log in to your account and update your communication preferences in Settings → Notifications; or
- Contact us at privacy@farmops360.com and request removal.
After you send STOP, we will send you a single confirmation message and no further marketing or informational texts will be sent, except that we may continue to send strictly transactional messages related to your active account (e.g., security alerts, billing receipts) as permitted by law. To re-subscribe to marketing messages at any time, text START to the same number.

3.5 Message and Data Rates
Message and data rates may apply. FarmOps360 does not charge for SMS messages; however, your mobile carrier may charge standard messaging and data rates. Contact your carrier for details on your plan.
3.6 Message Frequency
Message frequency varies. Transactional messages are sent as triggered by account activity. Informational and marketing messages are sent no more than a reasonable number of times per month based on your subscription tier and preferences. You will be notified if message frequency changes materially.
3.7 Supported Carriers
FarmOps360 SMS services are supported by major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Carrier support may vary. FarmOps360 and participating carriers are not liable for delayed or undelivered messages.
3.8 No Sharing of Phone Numbers for Third-Party Marketing
We will not sell, rent, lease, or share your mobile phone number with third parties for their own marketing purposes. Phone numbers collected for SMS communications are used solely to deliver messages described in Section 3.1 and to maintain records of consent as required by applicable law.
3.9 Consent Records
We retain records of your SMS opt-in consent, including the date, time, method of consent, and the specific disclosure language presented at the time of opt-in. These records are maintained in accordance with TCPA requirements and applicable carrier rules (including CTIA guidelines and 10DLC campaign registration requirements). Opt-out requests are logged and honored within the timeframe required by law.
4. How We Use Your Information
We use the information we collect to:
- Provide, operate, and improve the FarmOps360 platform;
- Process transactions and send related communications;
- Send SMS messages for which you have given consent;
- Respond to your inquiries and provide customer support;
- Comply with legal obligations, including maintaining opt-in and opt-out records;
- Enforce our Terms of Service and protect against fraud or abuse; and
- Conduct analytics to understand how our Service is used.
5. Disclosure of Your Information
We may share your information with:
- Service Providers: Third-party vendors who assist in operating our platform, processing payments, sending communications, or providing customer support, subject to confidentiality obligations;
- SMS Aggregators / Carriers: As required to deliver text messages you have opted in to receive;
- Legal Authorities: When required by law, court order, or to protect our rights or the rights of others; and
- Business Transfers: In connection with a merger, acquisition, or sale of assets, with notice provided to you.
We do not sell your personal information as that term is defined under the California Consumer Privacy Act (CCPA) or other applicable state privacy laws.
6. California Privacy Rights (CCPA / CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):
- Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collection, and the categories of third parties with whom we share it.
- Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions.
- Right to Correct: You may request correction of inaccurate personal information we maintain about you.
- Right to Opt Out of Sale or Sharing: We do not sell or share your personal information for cross-context behavioral advertising. If this changes, we will provide a "Do Not Sell or Share My Personal Information" link.
- Right to Limit Use of Sensitive Personal Information: You may request that we limit use of sensitive personal information to that which is necessary to provide the Service.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.
To exercise any of these rights, submit a verifiable consumer request to privacy@farmops360.com or use the contact information in Section 9. We will respond within 45 days as required by law.
SMS-Specific California Rights: California residents may opt out of receiving marketing text messages at any time by replying STOP to any message or contacting us as described in Section 3.3. Opting out of marketing texts will not affect your access to the FarmOps360 platform or any other rights.
7. Data Retention
We retain personal information for as long as necessary to provide the Service and fulfill the purposes described in this policy, or as required by law. SMS consent and opt-out records are retained for a minimum of four (4) years in accordance with TCPA statute of limitations requirements. Upon verified request for deletion, we will delete or de-identify your personal information within the timeframe required by applicable law, except where retention is required for legal compliance.
8. Security
We implement industry-standard technical and organizational measures to protect your personal information, including encryption in transit and at rest, access controls, and regular security assessments. No method of transmission or storage is 100% secure. If you have reason to believe your interaction with us is no longer secure, please contact us immediately.

10. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this page and, where appropriate, by sending you an email or SMS notice. Your continued use of the Service after any changes constitutes acceptance of the revised policy.
